CHOOSING AMONG INNOCENTS: SHOULD DONATIONS TO CHARITIES BE PROTECTED FROM AVOIDANCE AS FRAUDULENT TRANSFERS?
- Authors
Davis, Jeffrey
- Abstract
An essay is presented on ways in which law chooses among innocents. It discusses whether donations to charities be protected from avoidance as fraudulent transfers and reflects on donations made by Ponzi schemes, a fraudulent investment operation that pays returns to its investors from their own money, rather than from profit earned by the individual running the operation, in this regard. The author argues that charitable donations should be protected and warranted under state laws.
