- Abstract
The article explores the history of the Act of State presumption and uses policy and law to contend for changing the presumption to allow for more claims to be brought against rogue foreign regimes in the U.S. It discusses several rationales of the Act of State such having constructional underpinnings. It states that the U.S. must acknowledge the threat of foreign expropriation and protect its citizens who are investing abroad.
