- Abstract
The article examine the U.S. Supreme Court case Ramos v. Louisiana, which overturned Apodaca v. Oregon. It mentions the role of the juror in capital sentencing and the racial consequences created by nonunanimity in capital sentencing. It examines why Ramos, combined with the precedent set forth in Ring v. Arizona and Hurst v. Florida, implies that Supreme Court precedent regarding the Sixth and Eighth Amendments guarantees a unanimous jury verdict as to death.
