- Abstract
This article explores the recent trend of novel causes of action related to abortion in the United States, focusing on the Texas law known as SB8. The law allows anyone to sue those involved in an abortion for damages. In response, other states like Connecticut have passed shield laws to protect abortion access and allow individuals to sue to reclaim any damages they had to pay out in Texas. The article discusses the implications of these new causes of action and their broader cultural consequences, suggesting that similar approaches may be used in other contentious issues beyond abortion. It also raises concerns about privacy invasions, erosion of trust, and the transformation of tort law into a personalized, grievance-based system. The author highlights the need for legal clarity and open dialogue to find workable solutions in the face of differing state approaches.
