- Abstract
The study "Less lawsuits, more conflict management?" examines the decline in the number of lawsuits filed in the German civil justice system and also considers alternative dispute resolution methods such as conciliation, arbitration, and mediation. The study concludes that these procedures are gaining importance but cannot solely explain the decrease in lawsuits. The number of cases filed with conciliation bodies has increased, but there is no clear evidence of cases migrating away from the civil justice system. Arbitration is seen as an alternative to the state judiciary, especially in disputes between companies. However, the use of mediation, conciliation, and arbitration by companies has decreased in the last ten years.
