- Abstract
The article discusses a court case wherein a plan participant who received a continuation bonus or additional benefits, did not suffer from material reduction in aggregate benefits. It cites the case filed by Bradford Stone against Chevron Corp./Unocal retirement benefit plans which denied his benefits as mandated by the Employee Retirement Income Security Act (ERISA). However, the Court held that there is no constructive discharge of benefits and Stone's claim was properly denied.
