- Abstract
The article presents the case of James Geissal, an employee at Moore Medical Corp. for filing a suit against his employer alleging a Consolidated Omnibus Budget Reconciliation Act of 1985 (COBRA) violation by denying him continued coverage under the group health plan. It points out that an employer cannot deny continuation medical coverage under COBRA to an otherwise qualified former employee simply because he or she was also covered under another group health plan at the same time the election to continue medical coverage under COBRA was made.
