- Abstract
The article discusses a court case wherein United Phosphorus Ltd. (UPL) filed an action against the decision of the European Commission on November 7, 2008 to exclude Napropamide as an active substance in Annex I to Directive 91/414. The decision provided that member states of European Union were to withdraw authorizations for plant protection products containing napropamide by May 7, 2009. UPL claimed on February 26, 2009 that the decision was based on a series of manifest errors of appraisal.
