- Abstract
The author discusses the preemption standard introduced by the U.S. Dodd-Frank Wall Street Reform and Consumer Protection Act (Dodd-Frank) to state unfair or deceptive acts or practices (UDAP) laws. The preemption regulations was introduced through the amendments of Dodd-Frank to the National Bank Act (NBA). The author further highlight the U.S. Office of the Comptroller of the Currency's (OCC) application of the NBA preemption on the Barnett Bank of Marion County v. Nelson.
