The article discusses the aviation-related U.S. court cases that have foreclosed a constitutional analysis of discriminatory deplaning concerning airline industry, as of October 2014.Topics discussed include the U.S. Supreme Court's frameworks for finding state action in the industry, standard of scrutiny that courts apply to a pilot's decision to remove passengers, the U.S. court case 'Williams v. Trans World Airlines,' and introduction of the Aviation and Transportation Security Act.
