- Abstract
The article focuses on the case between Suzette Juman and Jade Doucette in the Supreme Court of Canada wherein the proceeding requires a party to apply evidence obtained through mandatory disclosure for litigation purposes. Evidences based on documentary investigation can be exposed on a case to case basis by those who hold authorities. Implied undertakings in civil litigation is significant in particular cases and exclusion of evidences can serve as a protection against self-incrimination.
