- Abstract
The author discusses clarification on viewpoint discrimination in First Amendment free speech doctrine. Topics covered include an overview of free speech doctrine in terms of the various standards of scrutiny when viewpoint discrimination either is or is not occurring, how to make the overall doctrine more predictable in various areas of free speech doctrine, and the distinction between content-based and content-neutral regulations of speech shown in the 1968 case of U.S. v. O'Brien.
