- Title
SURVEY OF RECENT DEVELOPMENTS IN INDIANA PRODUCT LIABILITY LAW.
- Authors
Alberts, Joseph R.; Petersen, James; Thornburg, Robert B.
- Abstract
The article discusses the changes in the Indiana Product Liability Act (IPLA) during the survey period from October 1, 2007 to September 30, 2008. IPLA was first enacted in 1978 in which its original coverage concerns claims in tort utilizing both negligence and strict liability theories. Several cases on product liability are examined, one of which is Riegel v. Medtronic Inc., tackling express federal preemption. It concludes that some of the provisions in IPLA remain posing a challenge to both court and practitioners.
