CONSTRUTING THE SKELETON: WHAT'S LEFT OF ANTITRUST IMMUNITY AND THE FILED RATE DOCTRINE FOR MOTOR CARRIERS?
- Authors
Andrews, Mark J.
- Abstract
The article discusses the antitrust immunities premised on the existence of economic regulation in the U.S. It mentions that the immunity for collective ratemaking provides a procedure for immunizing collective agreements through household goods rates, joint rates, and mileage guides. Moreover, the Surface Transportation Board (STB) retains discretionary power under 13703 to re-immunize collective agreements since it is difficult to envision any circumstance in which the power could be used.
