- Abstract
In the article, the author examines the non-cognitivist defense of the U.S. Supreme Court's obscenity doctrine in its alleged bid to adopt sexual frankness while preserving the historic exemptions from the First Amendment's free speech provisions. Also cited are the views of academic Frederick Schauer in supporting the court's position, and the court's test for obscenity in analyzing hardcore pornography.
