- Abstract
The article discusses the U.S. federal law covering a defendant's competence to face trial in a federal criminal jurisdiction, as well as the reasons why there is a need to amend the law as of April 2019. Other topics include the Supreme Court decision in 'Dusky v. U.S.' in relation to the law, the law's criteria in determining competence of a defendant, and the key role played by forensic psychiatrists in assessing a defendant's competence to stand trial.
