- Abstract
Because of the role played by the Catholic Church when they are hired, the employment status of Catholic religion teachers has a distinctive nature. Competence is a key concept in this regard, and likewise when the Church regards the defining circumstances of such competence as having been lost, thus revoking the original decision to hire. The legality of the Church's decision in this context has been validated by the Constitutional Court, on condition that the reasons are exclusively religious and that the fundamental rights of teachers are not undermined. However, a recent court decision has rejected any revision of teacher competence, even on religious grounds. The Constitutional Court paid little heed to the significance of the conditions taken into consideration by the Church, thus infringing the Church's prerogative by ignoring the principle of neutrality.
