Abstract
This article focuses on the court ruling given in In Re Apex Vanitory Corp. case. Award confirmed despite nine-month delay between first and second hearing, the court holding that this delay did not "constitute such misconduct on the part of the arbitrators as to warrant a vacatur of the award." Any problem arising out of the delay was assumed to have been "cured by the three hearings" after the delay.
