- Abstract
This article aims to open a discussion concerning religious boundaries, more precisely the slaughter of animals, and the legal dictates that address the need to protect vulnerable members of society, in the case of animals. As a problematizing question, it is sought to understand how the action of the secular State takes place in the face of the limits of religious action on the slaughter of animals. The research method of this article is characterized as exploratory research with a bibliographical and normative survey on the subject and analysis of the discussion in judgment that is in the Supreme Court, Extraordinary Appeal n° 494.601 / RS regarding the sacrifice of animals in rites of religions of African matrix. The present study reveals that reflecting how the various ideas put into society about innumerable human behaviors and the need to ponder goods and values is essential for conscious decisions, based on the search for human harmony. To defend ritual slaughtering in the religions that are based on this practice is to preserve religious freedom, which is free in the need of previous animal stunning before the prohibitive constitutional rule that deals with the prohibition of cruel acts against animals.
