- Abstract
The National Electric Energy Agency has been publishing in recent years some regulatory measures that have come to model the implementation of the first pilot projects of smart grids in Brazil. Thus, the present study proposes to analyze the legal framework modeling the Brazilian experience, taking into account juridical and sociological aspects, inherent to the unequal urban formation of the country. The research resorted to the hypothetico-deductive and argumentative dissertation methods. It focuses on national and foreign bibliographic review, and on the dialogue between doctrine and official statistics. Thus, the link between the right to energy and the right to the city in the conceptual perspective of Henri Lefebvre (2008), is discussed, establishing the intersection between the concepts of smart city and smart grid. From then on, the models applied in the USA and the European Union are compared with national regulations. Finally, the official results of the experiments implemented in Brazil are taken as a practical contribution. Finally, the research sheds light on the difficulties posed by the creation of technological demand before legislative and technical standardization in the country, while offering relevant considerations to the public debate in search of the efficiency of the Brazilian project of intelligent electric grids.
