- Abstract
Despite the progress of medicine, prophylactic and modern pharmacotherapy, infections in the hospital are still serious problems of closed medicine. They are very closely related to the presence of complications following a medical or nursing treatment. Civil law codes regulate the condition for the damage suffered in relation to other non-material harm premises. In health care, the most important criminal offense is "offense" and "risk" crime. There are two variants of civil liability in the context of a hospitalic infection - liability based on defective performance by a health care provider or private practice, and liability based on the principle of tort. In the context of preventing and combating infections and infectious diseases in humans, the responsibilities of the health care facility have been imposed on the business. Failure or incorrect implementation of these requirements is a neglect of the medical institution and a condition for assuming responsibility for the healthcare facility for hospital infections.
