- Abstract
The article focuses on requirement of publication, an element of internet defamation and an issue raised after the decision of the Australian High Court in the case Dow Jones v. Gutnick. It examines the defendants' potential in internet defamation claims to have a defence of innocent dissemination and the impact of judicial perceptions of internet on relevant principles. It suggests that publication concept has to be refined, to eliminate conduct that may result defamatory matter dissemination.
