- Abstract
The article discusses the authors' view concerning the challenges of cartel class actions litigations in Australia. These challenges include during the regulatory prosecution and individual damages actions. However, the authors cite that they focus on the three issues that prominently affect in the cartel class action litigations that likely have significant consequences for future conduct including pleading of market, jurisdictional issues and assessment of damages. They also clarify that there still no cartel class actions litigation reached in trial courts.
