- Abstract
The article discusses the first reported application of color trademark legal protections in America in the wake of several court rulings in 2012 involving designs by the Christian Louboutin S.A. shoe company and the Maker’s Mark Distillery Inc.'s red-colored wax seal. According to the article, the U.S. Trademark Trial and Appeal Board applied a four-step trademark protection analysis prior to denying Florists’ Transworld Delivery Inc.'s attempt to trademark the color black in 2013.
