- Abstract
The article analyzes the policies behind the U.S. Copyright law. It assesses the origin of the copyright misuse doctrine. It applies the copyright misuse doctrine for explaining two court cases Vernor v. Autodesk and Triad Systems Corp. v. Southeastern Express Co., to determine whether complete restriction on resale of software through license should be permitted and whether copyright holder should be able to prohibit nonlicensees from servicing the copyright holder's software.
