- Abstract
In the global landscape, it is exceedingly rare to find a context where the state-building trajectory adeptly merges international intervention with the genuine integration of domestic aspirations, all while maintaining a foundation of robust functionality. This study delves deeply into the internationalized process of constitution crafting and state formation in the Republic of Kosovo. It posits that, notwithstanding the compromises made, the chosen constitutional framework for Kosovo has not only exceeded the initial expectations of its drafters concerning its practical implementation but also underscores values deeply ingrained in the collective consciousness of its people. Moreover, this analysis intricately dissects the linguistic strategies adopted by the drafters of the declaration of independence. Through their deliberate wording, they effectively carved out the unique identity of the nascent state, setting it apart from the international frameworks that had previously overseen its governance in the post-war era. Nevertheless, the paper concludes that the Ahtisaari Plan, which served as the cornerstone for Kosovo's Constitution, has in certain instances transcended its original parameters, asserting precedence over the constitution in decisions rendered by the Constitutional Court.
