- Abstract
Legal sources, with which social and economical relations in the country and internationally are regulated, are numerous and very heterogeneous, observed also by the effects that are reflected in today's market and globalization. These sources are formulated, formalized and ratified by authoresses bodies and institutions in a way that regulate a large number of practical problems giving particular importance to the essential option of possible disputes. Despite the law and legal system, relations between certain entities to large extent are regulated by bilateral and multilateral contracts. The number of contracts is large and their types grow constantly based on the needs of entities and business in general. Among traditional contracts are those of adhesion. Truly, their role in practice is large in terms of a simple technique on closing a contract and efficiency to meet the requirements of the parties respectively the costumers. But, in scientific circles the debates and opinions continue due to the fact that in this case only one party determents the conditions and elements of the contract, whereas the other party does not have any other option but to accept it or not. The superiority of one party in relation to the other party makes the principle of autonomy and equality of parties closing the contact contestable. If this principle is violated, then should the relations between these parties be considered a contract?
