- Abstract
The High Court of Justice of Castilla y León has issued a ruling on an appeal filed by the Association "Ecologistas en Acción de Valladolid" against the General Urban Development Plan (PGOU) of Tudela de Duero. The court considers that some changes in the land classification are appropriate, but declares null the paragraph that allows the legalization of houses built outside the plan. The construction of a "tool shed" in common rural land is also questioned. The court analyzes the necessity and justification of urban development and housing construction in the municipality, and although it considers that the legal requirements have been met, it declares the nullity of certain aspects, such as the classification of protected lands and the inclusion of isolated houses in the planned regime. The importance of the PGOU Report and the need to plan residential development are highlighted.
