The article offers information on the evolution of the rule 23(b)(2) of the U.S. Federal Rules of Civil Procedure. As stated, the rule allowed plaintiffs to obtain injunctive relief against discriminatory conduct. A brief survey of cases wherein insurance companies faced defending class actions brought on by African-American policy holders are discussed.
