The article discusses a U.S. copyright law-related fair use analysis requirement in the context of the purpose of America's Digital Millennium Copyright Act, focusing on takedown notices and the potential effect of such a requirement on copyright holders' abilities to respond to incidents involving Internet-related copyright infringement and piracy. Misrepresentation claims, freedom of speech in the U.S., and legal cases involving parties such as Universal Music Corp. are examined.
