- Abstract
The article compares the England and South African criminal justice system with reference to the charges made against 270 platinum miners of Marikana, South Africa, for the murder of their 34 colleagues shot by the South African Police Service. It refers to two legal exercises namely novus actus interveniens, known as breaking the chain and common purpose doctrine. It cites a few similar legal cases in Great Britain to compare it with the Marikana miners' case.
