- Abstract
The article presents a comparison of the copyright law in the U.S. and Canada in relation to the doctrine of fair use and nonfiction films as of September 2011. Nonfiction filmmakers reportedly must deal with the issue of copyright clearances for pre-existing works which can be prohibitively expensive. The topics of clearance reports and errors and omissions (E&O) insurance are also examined. The legal doctrine of fair use is analyzed under the U.S. Copyright Act of 1976 and Canada's pending fair dealing legislation.
