- Abstract
Land use in Latvia is influenced also by global tendencies like the climate changes, growing demand for alternative energy resources. That's why within the framework of land policy is necessary to improve the planning process of territory development, necessary more effective to use the accessible financial instruments, to improve knowledge of land owners about the sustainable land use and necessary to make in balance land demand for land development for different purposes. These conditions indicate actual problems in the planning of territorial development and improvement of it. The target of research are to clarify and evaluate the opinion of state and municipal officials, representatives from public about the territory planning, land acquisition and compensation issues and as a result will be drafted proposals for improvement of land policy in Latvia. The research consists of: • questionnaire of the state and municipal officials and representatives from private business; • by questionnaire is clarified the opinion of respondents about the managing process of territory planning, about land acquisition for territory development and land compensation issues; • conclusions and recommendations. By questionnaire is clarified that 33% of 114 respondents think, the local municipalities must guide all the development processes, 44 % think that, local municipalities must prepare all the necessary plans by itself; 18% think that, the local municipalities must have the pre-emption right to buy the land which is on the sale if it is necessary for implementation of valid plans; 20% think that, the licensed appraiser must determine the price of compensation if land is been expropriated. From the research can be made conclusions that the main role in the process of land development planning belongs to the state and municipalities, less to land owners and land developers. Attitude to the land compulsory acquisition is less negative if the objective of expropriation is concrete and explicit. In the case of expropriation, compensation has to be determined by licensed valuator and price may not be based on the cadastral value of real property. As conclusion from the research can be mentioned that there necessary to make amendments in the existing legislation concerning: • the compensation system for expropriated land; • development of land reservation system for the different public needs; • existing legal regulations on pre-emption rights by determining that such rights can be used just in cases if land is necessary for territory development.
