- Abstract
The article discusses the court case "Rescuecom Corp. v. Google Inc.," in which the U.S. Second Circuit granted relief to the plaintiff. The Second Circuit addressed the meaning of the phrase "use in commerce," in the Lanham Act. The Second Circuit held that Google's sale of the term to Rescuecom's competitors is a "use in commerce," as defined by the Lanham Act. The court however, did not address whether or not Google's use of the Rescuecom trademark is a violation under the Lanham Act.
