- Abstract
The article examines the restriction by the 2008 Ninth Circuit of the Court of Appeals opinion Fair Housing Councils v. Roommates.com on the section 230 of the Communications Decency Act in granting immunity to Internet exceptionalism in U.S. It offers an overview of the safe harbor with emphasis on the prior judicial interpretations of contributory liability. It also addresses the defects of the liability scheme of the Roommates.com decision.
