- Abstract
A thorough study of the legal treatment of unaccompanied young foreigners reveals a multiplicity of contradictions, since the matter is disciplined partly by laws that regulate the migratory flow and partly by juvenile law, which aims to protect and support. The intervention of social and jurisdictional professionals does not always pursue aims of tutelage and integration, but contributes to the establishment of the legal and social disadvantages of the foreign minors. This work illustrates the outcome of a survey, carried out until 2003 in Bari Juvenile Court, about unaccompanied foreign minors, which demonstrated that it is generally the custom to apply the bureaucratic-functional model, which determines significant inequalities between foreign and Italian minors in the enjoyment of essential rights. It is to be hoped that a constitutionally oriented reading of the law, together with a new vision of jurisdiction, may enable ambitious integration programmes to be embarked upon in future.
