- Abstract
The article discusses the legality of the attempt made by the U.S Commodity Futures Trading Commission (CFTC) to impose speculative position limits on off-exchange swap. Topics discussed include the U.S Supreme Court case Chevron, USA, Inc. v. Natural Res. Def. Council, Inc. that examines the statute de novo, Section 6a(a)(1) of the U.S Commodity Exchange Act (CEA) and the Wall Street Transparency and Accountability Act of 2010 (Dodd?Frank) that brought amendments to the CEA.
