- Abstract
The article discusses the statute enacted by the state of Vermont which aims to curbing bad faith patent assertions in the patent law. Topics discussed by the author include the historical overview of the growth of patent trolls in the U.S., how the statute considers the constitutional preemption of the Supremacy Clause of the United States Constitution, and the need for the federal legislature to either enact a federal law similar to Vermont or to adopt an amendment to existing legislation.
