- Abstract
The article discusses the Colorado Supreme Court's ruling in the case St. Jude's Co. v. Roaring Fork LLC which deals with water rights under the Colorado Doctrine prior appropriation system, the physical diversion of water away from a stream bed, and the definition of beneficial use in relation to the state's water rights laws. The legal aspects of fishing are examined, along with the environmental aspects of the nonconsumptive uses of water and Colorado's statutory and common law history.
