- Abstract
The article discusses the judicial opinion of the New Mexico Supreme Court on the case State v. Montoya and its application in the rule of lenity. Topics discussed include violating the double jeopardy in the action of voluntary manslaughter, role of rule of lenity in resolving the claims related to dwelling and homicide for violating double jeopardy and the judicial review of the judicial error related to the case of manslaughter.
