The author provides an analysis of debt discharges about the sale or exchange of property as affecting the potential realization of cancellation of indebtedness income (COD) in the U.S. He explores apparent contradictions in the approaches taken under the assumption of liabilities regulation and in case law. The article notes the amendment required by the uncertainty created by the Assumption Regulation to exclude nonrecourse debt from its scope.
