- Abstract
The author details the need for a rule that will protect queer jurors in the U.S. against peremptory challenges based on sexual orientation. She provides a historical background of peremptory challenge. She explores the limitations of the Supreme Court's ruling in Batson v. Kentucky including the failure to address racial discrimination in juries. She also discusses the General Rule 37 which was adopted in Washington state to limit explicit and implicit racial biases against jurors.
