- Abstract
The article discusses the application of the equitable estoppel legal doctrine to pension benefits claims involving the U.S. Employee Retirement Income Security Act (ERISA) of 1974, focusing on an analysis of the legal rights of employees in America as of November 2012. It states that federal courts in the U.S. should be allowed to entertain ERISA equitable estoppel claims which involve parties who detrimentally rely on fraudulent or negligent statements.
