- Abstract
This article recounts the success of the State of Illinois in defending its differential premium tax in the aftermath of the United States Supreme Court's ruling in Metropolitan Insurance Company v. Ward. The authors examine the regulatory implications of adopting, maintaining, or abolishing distinctions based on state of incorporation, location of principal place of business, etc. The article is presented in two parts. Part I, presented here, discusses the Illinois litigation in light of the federal constitutional framework.
