Federal Court Report Supports ADR.
- Abstract
The article presents information that the Judicial Conference of the U.S. has approved the final report featuring recommendations to change the use of alternative dispute resolution by courts and government agencies in the country. The report, which was based largely on a preliminary report prepared by the Judicial Conference's Committee on Long Range Planning chaired by Judge Otto R. Skopil Jr., is a response to the growing awareness that the accelerating pace of social change requires the courts to anticipate and plan for the future. Questioning what that future will be like in the year 2020, the report paints possible scenarios in which the federal courts could face such burdens as a fourfold increase in caseload, continuing growth in federal court jurisdiction and a shortage of financial resources. Acknowledging that the implications of these scenarios could have an apocalyptic effect on the courts' ability to dispense justice, the report adopts as its primary objective for the future the need to limit the jurisdiction of the federal courts, and all of its recommendations and implementation strategies stem from that objective.
