- Abstract
The article examines the Exxon Shipping Co. v. Baker case and how the federal and state courts have interpreted it in the U.S. It offers sample court decisions that cite Exxon Shipping Co. which were reviewed and analyzed if it has steered other courts in nonmaritime cases in reducing punitive and exemplary damages to 1:1 ratio. Further, it examines the future of punitive damages jurisprudence with Justice Sonia Sotomayor's arrival in the Supreme Court and Justice Paul Steven's departure.
