- Abstract
The article focuses on the application of the Digital Millennium Copyright Act (DMCA) to analog works and safeguards in the U.S. in light with the Murphy v. Millennium Radio Group case. It provides an overview of DMCA, Section 1202's legislative background and content. It explains the interpretation of the Third Circuit on the section based on legislative history. It accounts the practical effect of the case on litigation noting that the decision intensifies settlements in analogs acts of infringement cases and opens to legal intimidation.
