The article discusses the erosion of a parcel-as-a-whole rule which American courts often apply in regulatory takings litigation, and it mentions competing values regarding the allocation of social burdens and the economically beneficial use of property in the U.S. Fairness and America's Constitution are mentioned, along with the just compensation for property owners and the takings cases Koontz v.
