The article interprets the Section 20 (6) of the Einkommensteuergesetz (EStG) income tax law of Germany to deal with tax assessment of corporate losses. Topics discussed include provisions of the section that provides for cross-custodial offsetting of old losses; cross-custody account for old losses that is also required for constitutional reasons; and taxation of profits from investment income in the light of different provisions of income taxation laws.
