- Abstract
The article examines the success of Rule 37(e) of the U.S. Federal Rules of Civil Procedure compared to its predecessor, which provides relief to a party seeking discovery against one who, with or without stated objections, fails to afford the discovery sought. Topics include importance of discovery Rules and uniform data retention practices; amendments regarding discovery and electronically stored information; and changes to spoliation doctrine.
